AMICUS COMMITEE:

CDAM has an active history of filing friend of the court briefs in Michigan and federal courts. The Amicus Committee reviews cases currently pending in these courts to determine appropriate cases in which to file a friend of the court briefs. If a case is selected by the amicus committee, the committee will recruit a writer for the brief and then will file a brief supporting a particular position with the Court. Many CDAM amicus briefs have been scanned and are available from the State Appellate Defender's Office website. To see those briefs, click on link here.

CDAM selects appropriate cases by looking at:

Whether the issue involved will impact a large number of criminal defendants or defense attorneys;

Whether the issue involved was properly preserved in the lower courts;
Whether the Court has invited friend of the court briefs;
Whether the issue involved is one in which other courts have reached a conflicting ruling.

No one factor is dispositive, but each factor is considered.

If you you believe that you have an appropriate case for amicus intervention, please submit your case to:
